Introduction:

This purchase is governed by the standard terms and conditions below for consumer purchases of goods over the Internet. “Consumer purchase” here means sale of goods to a consumer who does not primarily act as part of a business activity, and where the seller operates a business selling goods over the internet. The contract is drafted and recommended for use by the Consumer Authority.

Consumer purchases over the Internet are mainly governed by the Contract Act, the Consumer Purchase Act, the Marketing Control Act, the Right of Withdrawal Act, and the E-commerce Act. These laws grant consumers non-waivable rights. The terms in the contract are not intended to limit the statutory rights, but rather set out the parties’ main rights and obligations for the transaction. The seller may choose to offer the buyer better terms than those stated in these terms and conditions.

In cases where the contract does not directly address an issue, the contract must be supplemented by the relevant statutory provisions.

 

  1. The Agreement

    The agreement between buyer and seller consists of the information provided by the seller about the purchase in the order solution in the online store (including, among other things, information about the nature, quantity, quality, other characteristics of the goods, price, and delivery terms), any direct correspondence between the parties (for example e‑mail), and these terms and conditions.

    In case of conflict between the information provided by the seller in the order solution in the online store, direct correspondence between the parties, and the terms and conditions, direct correspondence between the parties and the information given in the order solution shall prevail over the terms and conditions, provided that this does not conflict with mandatory legislation.

    The Buyer is the person who places the order.

     

  3. Prices

    For Norway:

    The prices shown in the online store include VAT.

    Details of the total costs the buyer shall pay, including all taxes (VAT, customs duties, etc.) and delivery charges (freight, postage, invoice fee, packaging, etc.), along with a breakdown of each element of the total price, are provided in the order solution before the order is placed.

    For foreign countries (outside Norway):

    The prices for deliveries outside Norway are shown excluding VAT. VAT has already been deducted from the displayed price. The buyer is responsible for paying any customs duties, import taxes, and other fees required by the laws and regulations in their respective country. These costs are not included in the purchase price and will be collected by the relevant authorities upon import.

     

  4. Formation of the Contract

    The contract is binding for both parties when the buyer’s order is received by the seller.

    However, a party is not bound by the contract if there has been a typing or input error in the seller’s offer in the order solution in the online store or in the buyer’s order, and the other party knew or should have known that such an error had occurred.

     

  5. Order Confirmation

    Once the seller has received the buyer’s order, the seller shall without undue delay confirm the order by sending an order confirmation to the buyer.

    It is recommended that the buyer checks that the order confirmation matches the order regarding quantity, product type, price, etc. If there is a discrepancy between the order and the order confirmation, the buyer should contact the seller as soon as possible.

     

  6. Payment


    Payment Methods

    In our online store, you can choose between several secure and user-friendly payment options:

    • Shopify Pay (debit/credit card) – available for both one-time purchases and subscriptions. Shopify Pay makes it easy to pay quickly and securely using saved payment details.
    • Vipps – Available only in selected countries. At checkout, these payment options will appear automatically if supported in your country and currency. Vipps is available only for one-time purchases. Note that Vipps cannot be used for subscriptions.
    • Klarna – Available only in selected countries. At checkout, these payment options will appear automatically if supported in your country and currency. Klarna is available only for one-time purchases. Note that Klarna cannot be used for subscriptions.

    We do not offer invoice payment or issue manual invoices.


    Payment for Subscriptions

    For subscriptions, payment is automatically charged every 4 months, and you will receive a receipt via email.

    You may cancel the subscription at any time, provided cancellation occurs at least 30 days before the next shipment.

  7. Delivery etc.

    Delivery of the goods from the seller to the buyer takes place in the manner, at the location, and at the time specified in the order solution in the online store.

    If no delivery time is specified in the order solution, the seller shall deliver the goods to the buyer within a reasonable time and no later than 30 days after the customer’s order. If the seller is responsible for ensuring shipment to the buyer, they must have the goods transported to the destination by suitable means and under normal terms for such transport. The destination is with the buyer unless otherwise specifically agreed between the parties.

    Delivery
    We dispatch orders the same day or the next business day. Orders placed on weekends or public holidays are shipped the next business day.

    Shipping Options in Norway:

    • Free mailbox delivery is included in the price.
    • Pickup point delivery is available as an option at checkout, for an additional fee.

    Shipping Options Internationally (outside Norway):

    • We ship via DHL using Webshipper. Shipping cost is calculated at checkout based on your delivery country. Once your package is dispatched, you will receive tracking information by email.

     

  8. Risk of the Goods

    The risk passes to you as the buyer when the goods are delivered in accordance with the agreement – whether delivered to the mailbox, pickup point, or via another agreed method.

    If the delivery time has arrived and you as the buyer fail to receive or collect the goods, you still assume the risk for any damage or loss caused by handling of the goods from the time they were made available to you.

    This does not apply to damage or loss caused by errors during transport or other matters for which we as the seller are responsible.

     

  9. Right of Withdrawal

    As a customer, you have the right to withdraw from the purchase in accordance with the Right of Withdrawal Act (§ 22 and § 23). This gives you the opportunity to return the goods within 14 days after receipt, without giving a reason.

    How to exercise your right of withdrawal:

    • You will receive a link to the withdrawal form with the order confirmation by email.
    • You can exercise the right of withdrawal by sending us a written notice (e.g., via email or the withdrawal form).
    • Return the goods to us within a reasonable time.
    • The return shipping cost is covered by you as the customer.
    • The goods must be returned unused, in their original packaging, and with unbroken seal.


    When we receive the goods, we will refund the full purchase price within 14 days.

    Exceptions:
    The right of withdrawal does not apply to goods that:

    • Have had their seal broken
    • Have been used

     

  10. Examination of the Goods

    Upon receipt of the goods, the buyer is advised to examine the goods to a reasonable extent to ensure they conform with the order, have not been damaged during transport, and are free from other defects.

    If the goods do not conform with the order, are damaged, or have defects, the buyer shall notify the seller as soon as possible, and no later than a reasonable time after the defect was discovered. This may be done in accordance with the complaint terms described in section 11.

     

  11. Complaint of Defect and Deadline for Delay Claims

    If there is a defect in the goods, the buyer must notify the seller within a reasonable time after the defect was discovered.

    For cosmetic products with limited shelf life, the right to complain is in line with the product’s expected lifespan. A complaint must therefore be made within this period. In case of visible or obvious faults, it is recommended to contact us as soon as possible after receipt.

    For delayed delivery, the buyer must notify within a reasonable time after the agreed delivery time has passed.

    If the goods were paid for with a credit card, the buyer may also choose to lodge a claim directly with the credit card issuer.

    All complaints should be made in writing via email or letter for documentation purposes.

     

  12. Buyer's Rights in Case of Delay

    If we fail to deliver the goods within the agreed time, and this is not your fault as the customer, you have rights under the Consumer Purchase Act.

    You may:

    • Demand delivery of the goods
    • Cancel the purchase if the delay is considerable
    • Claim compensation for documented financial loss


    Before you can cancel the purchase, you typically must give us a reasonable additional period to deliver. We cannot be held responsible for delays caused by circumstances beyond our control (e.g., strikes or force majeure).

    In case of delay, contact us as soon as possible. See also section 11 for information on complaints.

     

  13. Buyer's Rights in Case of Defect

    If the goods have a defect that is not your fault as the customer, you have rights under the Consumer Purchase Act.

    You may:

    • Demand repair or replacement (substitution)
    • Request a price reduction
    • Cancel the purchase if the defect is substantial
    • Claim compensation for documented financial loss


    Repair or replacement shall be provided at no cost to you and within a reasonable time. If this is not possible or is unreasonable for the seller, you may request a price reduction or cancellation, provided the defect is not insignificant.

    Claims must be submitted in writing to us and follow the rules for complaints described in section 11. The right of withdrawal and the right to complain apply independently of each other.

     

  14. Seller's Rights in Case of Buyer's Breach

    If you as the customer do not pay or fulfill the agreement, and this is not due to us as the seller, we may:

    • Withhold the goods
    • Demand payment (performance)
    • Cancel the purchase in case of substantial breach
    • Claim compensation for documented financial loss
    • Demand interest and fees for late payment or unclaimed goods


    Late Payment

    If payment is overdue, we may charge interest pursuant to the Late Payment Act. After a reminder, outstanding amounts may be sent to debt collection, and you may be charged a collection fee.

    Unclaimed Goods/Packages
    If a package is not claimed and is returned to us, the customer will be charged a fee covering our actual return freight and handling costs.

    For Norway:

    • For non-prepaid orders, a fixed fee of NOK 250 plus return shipping is charged.
    • For prepaid orders, the purchase amount is refunded minus return shipping costs and an administrative fee of NOK 75.

    For international orders (outside Norway):

    • For non-prepaid orders, a fixed fee of NOK 350 plus return shipping is charged.
    • For prepaid orders, the purchase amount is refunded minus return shipping costs and an administrative fee of NOK 150.


    The fee does not apply to customers under 18 years old. An unclaimed package does not count as a valid exercise of the right of withdrawal – if you wish to use the right of withdrawal, you must collect the package and return it according to the instructions.

     

  15. Warranty

    We offer no extended warranty beyond the statutory rights. If the product is damaged upon receipt, we will of course replace it at no cost. Otherwise, your rights under the Consumer Purchase Act apply as usual, including for complaints due to defects or faults.

  16. Personal Data and Use of Cookies

    We take your privacy seriously and process personal data in accordance with applicable data protection legislation (GDPR).

    We collect and store only the personal data necessary to fulfill your order and our obligations under the contract. We do not share personal data with third parties unless required for delivery (e.g., a shipping company) or required by law.

    Use of Cookies and Analytics Tools
    We use cookies to provide a better user experience, analyze traffic, and improve our services.

    Google Analytics
    We use Google Analytics to collect anonymized information about how visitors use our site.

    This includes information such as:

    • Which pages you visit
    • How long you stay on pages
    • Which device and browser you use
    • Whether you have visited our site before


    The information collected is sent to and stored on Google’s servers, which may be located outside the EU/EEA. We have enabled IP anonymization in Google Analytics so that your IP address is shortened before being sent to Google and cannot be used to identify you personally.

    You may at any time opt out of Google Analytics by installing the Google Analytics opt‑out extension in your browser.

    Hotjar

    We use Hotjar to gain better insight into how visitors interact with our site. Hotjar uses cookies and other technology to collect data about user behavior, such as:

    • Click, tap, and scroll activity
    • Visited pages and time spent on the site
    • Device type, browser, and screen size
    • Anonymized feedback via surveys or polls


    The data is anonymized and aggregated before being analyzed. Hotjar stores this information on servers that may be located outside the EU/EEA.

    Triple Whale

    We use Triple Whale for e‑commerce analytics and marketing attribution. This helps us understand how customers find and use our online store, so we can improve the shopping experience and measure marketing effectiveness. Triple Whale may collect anonymized data such as:

    • Purchase history and order value
    • Referral sources and campaign results
    • Visitor interactions prior to purchase


    Triple Whale processes this information according to its own privacy policy. Data may be stored outside the EU/EEA.

  17. Dispute Resolution

    We want satisfied customers, and if disagreements arise, we hope to resolve the issue amicably. Please contact us at support@norvivo.no, and we will try to find a good solution together.

    If we are unable to reach an agreement, you may contact the Consumer Council for assistance and mediation. Should the matter not be resolved through the Consumer Council, the dispute may be handled by the Consumer Disputes Commission. Their decision is binding for both parties four weeks after it is issued.

    Before the decision is final, either party may also choose to proceed to court.
